South Carolina UM/UIM Stacking, Class I/Class II Insureds & Multiple Policies
South Carolina stacking rights depend heavily on whether the claimant is a Class I insured, generally a named insured or resident relative, or a Class II insured whose status arises from occupancy or use of the covered vehicle. Class I insureds may have broader stacking rights, while Class II insureds generally do not stack coverage beyond the involved vehicle.
- Classify the claimant under each policy before calculating available UM/UIM limits.
- Identify every vehicle and every policy under which the claimant may qualify as an insured.
- Apply statutory limits and current South Carolina case law to stacking across vehicles and policies.
- Do not assume identical stated limits produce identical recoveries for Class I and Class II insureds.
