Tennessee litigation rules permit insurance discovery

Tennessee Rule of Civil Procedure 26.02 permits discovery of the existence and contents of qualifying insurance agreements that may satisfy or reimburse a judgment. Use the rule once litigation begins if coverage remains incomplete.

Discovery is not the same as a pre-suit disclosure statute

Do not describe Rule 26.02 as a universal pre-suit duty to reveal every policy or limit. Before suit, coverage investigation generally depends on voluntary production, statutory duties that fit the claim, and factual investigation.

TNC claims carry an additional information-exchange rule

For TNC claims, §§55-12-141 and 56-7-1119 require the TNC and relevant insurers to cooperate in claim investigation and exchange specified log-on/log-off and coverage information.

Request the complete contract, not just limits

Request declarations, policy forms, endorsements, umbrella/excess information, denials, reservations and relevant selection/rejection records. Limits without the operative coverage terms are not enough for a reliable coverage analysis.

Current-law review: October 4, 2026. Verify the accident-date policy, current primary authority, later case treatment, and claim-specific deadlines before legal reliance.

PUBLIC-INTEREST LEGAL EDUCATION

VictimsGuide does not provide legal services or create an attorney-client relationship. Insurance requirements, deadlines, remedies and controlling authority can change. Verify current primary authority, policy language and the law applicable to the particular event before legal reliance.

Authorities and source notes

Registry authority mapping and cited propositions reviewed October 4, 2026. Canonical source preservation and formal subsequent-history review remain maintenance items where noted.

Bottom line. Preserve Tennessee-specific liability, UM/UIM, policy, factual and current-authority issues before legal reliance.
