Start with the complete contract

Coverage depends on the policy that applies to the person, vehicle, event and policy period. Obtain the declarations, coverage forms, definitions, exclusions, conditions and every endorsement. A declarations page alone may omit the provision that decides the dispute. Separate liability, uninsured-motorist, underinsured-motorist, medical-payment and vehicle-damage coverage before analyzing a denial.

Read disputed language in context

Folkman v. Quamme, 2003 WI 116, explains that policy language is read as a reasonable insured would understand it in the context of the policy as a whole. Ambiguity requires reasonable competing interpretations; disagreement with an insurer does not itself establish ambiguity. The court found the particular liability-limit language unambiguous. Its dollar amount is a fact of that policy, not a universal Wisconsin minimum.

Check statutes as well as exclusions

Wis. Stat. § 632.32 regulates automobile-policy provisions, including permissive-use coverage and specified restrictions. A proposed exclusion must be evaluated against the statute and the applicable policy language. Do not transfer a result about one coverage part to another or assume a general rule overrides every statutory exception. The relevant policy and law may depend on when coverage was issued or renewed.

Build a coverage comparison

Make a table identifying each requested benefit, the initial coverage grant, the insurer’s cited exclusion, any exception or endorsement, and the facts each provision requires. Request a written explanation that identifies the actual policy language. Keep the envelope, electronic delivery record, application, renewal notices and earlier policy versions if wording or delivery is disputed.

Coordinate the next steps

Distinguish a duty to defend a lawsuit from the duty to pay a covered judgment. Preserve claim and suit papers, tender requests and responses. Review notice, cooperation and other conditions before taking a step that may affect coverage. A policy dispute does not resolve crash liability, damages or any separate filing deadline.
