Determine the driver's exact digital-network status

Alabama TNC coverage changes depending on whether the driver is offline, logged on and available but not on a prearranged ride, or engaged in a prearranged ride. Preserve the TNC, driver, vehicle, accident time, trip ID, ride receipt, screenshots and messages. Do not automatically apply Chapter 7C to delivery apps or transportation services outside the statutory TNC definition.

Waiting-period coverage is at least 50 / 100 / 25

Section 32-7C-2 requires at least $50,000 bodily injury/death per person, $100,000 per incident and $25,000 property damage while logged on and available but not engaged in a prearranged ride, plus other state-mandated motor-vehicle coverage. Coverage can be maintained by the driver, the TNC or a combination.

A prearranged ride requires at least $1 million liability coverage

During a prearranged ride, § 32-7C-2 requires at least $1,000,000 in primary liability coverage. If driver-maintained coverage lapses or does not provide the required protection, TNC-maintained insurance must respond from the first dollar and has the duty to defend. The TNC policy cannot be conditioned on the personal insurer first denying the claim.

Personal-policy exclusions and coverage disclosure are expressly authorized

Section 32-7C-4 permits personal auto insurers to exclude liability, UM/UIM, MedPay and physical-damage coverages during defined TNC activity. The TNC must disclose its coverage to drivers, and insurers potentially providing TNC coverage must disclose applicable coverages, exclusions and limits to another insurer involved in the claim upon request. The driver must also disclose app status after an accident when requested.

Closing guidance

For an Alabama rideshare crash, lock down app status first, then compare the statutory TNC policy, personal-policy exclusions and any UM/UIM protection before deciding which insurer and limit applies.
