Alabama Auto Insurance & Crash Law
VictimsGuide’s Alabama library organizes the insurance and liability rules that can control a serious motor-vehicle claim, including required liability coverage, UM/UIM, policy interpretation, coverage disclosure, claims handling, employer and commercial coverage, government claims, contributory negligence, wrongful death, medical liens, settlement and controlling case authority.
Alabama rules to identify early
- Minimum liability: Alabama requires at least $25,000 per person, $50,000 per accident for bodily injury, and $25,000 for property damage.
- UM/UIM: uninsured-motorist coverage is governed by Alabama’s mandatory-offer statute and should be analyzed with any written rejection and the complete policy.
- Contributory negligence: Alabama retains the contributory-negligence doctrine, making liability analysis unusually important; wantonness and other doctrines require separate treatment.
- Wrongful death: Alabama’s wrongful-death remedy is distinctive because damages are punitive rather than compensatory.
Preserve the declarations and endorsements, crash report, photographs, video and electronic evidence, and investigate household, employer, commercial, umbrella and excess policies before executing any release.
