Who Is an Insured Under Alabama Auto Insurance?

Insured status must be read from the coverage actually being claimed
Liability, UM/UIM, MedPay and other policy parts can define insured persons differently. Start with the accident-date declarations, insuring agreement, insured definition, exclusions and endorsements for the specific coverage. Named insured, resident relative, permissive user and vehicle occupant are different categories. The fact that a vehicle is insured does not automatically establish that every driver or passenger is an insured for every coverage.
Section 32-7-23 protects persons insured under the policy; the policy identifies who those people are
The Alabama UM statute requires protection for 'persons insured thereunder' unless the named insured rejects the coverage. It does not create one universal statutory definition covering every driver, passenger or household member. Travelers v. Jones illustrates the point: passengers qualified because the policy's UM language made them insureds. Once insured status existed, the statutory stacking provision applied. Obtain and apply the actual policy definition rather than assuming passenger status alone decides coverage.
Household, permission, occupancy and vehicle-use facts can control
When a carrier disputes insured status, preserve residence evidence, family relationship, vehicle ownership, permission, occupancy and regular-use facts. For employer, rental or rideshare cases, keep the business or platform records separately. Ask the insurer to identify the precise definition or exclusion and the facts it says trigger the provision. A factual dispute about residence or permission is different from a legal dispute over what the policy wording means.
Clear insured definitions are ordinarily enforced as written
Herrera explains that Alabama courts enforce unambiguous insurance policy language as written; genuine ambiguity is resolved against the insurer, but courts do not create ambiguity through strained reasoning. An undefined term is not automatically ambiguous. Test the actual insured definition in context and identify competing reasonable interpretations before invoking ambiguity or reasonable expectations.
Closing guidance
Ask who is an insured for this coverage—not simply who was in the car. Match the policy definition and endorsements to the claimant's household, permission, occupancy and vehicle-use facts.
