Determine the driver's exact app stage

Arkansas TNC insurance changes according to whether the driver is offline, logged on and available but not engaged in a prearranged ride, or engaged in a prearranged ride. Preserve the platform, driver, vehicle, accident time, trip ID, ride receipt, app screenshots and passenger/driver messages. Do not automatically apply the TNC statute to every delivery app, taxi, limousine or other for-hire activity without checking the statutory definitions.

Arkansas uses different liability limits for the waiting and ride periods

Section 23-13-709 requires at least $50,000 bodily injury/death per person, $100,000 per accident and $25,000 property damage while a driver is logged on and available but not engaged in a prearranged ride. During a prearranged ride, the required aggregate liability coverage is at least $1,000,000. Obtain the policy and endorsements rather than assuming the platform's advertised limit describes every coverage, insured or accident stage.

Personal-auto exclusions and TNC backup coverage must be read together

Arkansas permits a private-passenger insurer to exclude specified liability, UM/UIM, first-party medical and physical-damage coverages during defined TNC activity. Section 23-13-709 also provides backup protection when driver-provided coverage has lapsed or does not provide the required TNC coverage and addresses defense obligations. Therefore, obtain both the driver's personal policy and the TNC policy. A personal insurer's denial does not by itself identify the complete coverage available for the crash.

Use the statutory claims-investigation route to lock down app timing

Section 23-13-711 requires cooperation among the TNC and relevant insurers in claim investigation. On request from a private auto insurer, the TNC must provide specified information—including precise log-on and log-off times within the statutory period—within 10 business days. The driver also has proof/disclosure obligations under § 23-13-709. Preserve the request and response because app timing can determine which statutory coverage stage applies and which insurer must respond.

Closing guidance

For an Arkansas rideshare crash, establish the app stage first, then compare the statutory TNC coverage, the driver's personal-policy exclusions, and the platform's claim-investigation records before deciding which insurer and limits apply.
