Arkansas rules to identify early
- Minimum liability: Arkansas requires at least $25,000 per person and $50,000 per accident for bodily injury or death, plus $25,000 for property damage.
- UM/UIM: Arkansas automobile policies are subject to statutory uninsured- and underinsured-motorist offer/rejection rules; the signed forms and complete policy matter.
- Comparative fault: Arkansas uses modified comparative fault. Recovery is available when claimant fault is less than the fault attributed to the party or parties from whom recovery is sought, with damages reduced proportionally.
- Coverage investigation: owner, household, employer, commercial, umbrella and excess coverage should be investigated before a final release.
