STATE LAW – HAWAII LIBRARY – GUIDE 07

Hawaii Insurance Policy Interpretation, Exclusions & Coverage Disputes

Coverage disputes require reading the policy as a whole and applying Hawaii statutes, no-fault requirements and controlling case law to insuring agreements, definitions, exclusions, conditions and endorsements.

Hawaii starts with the policy’s plain language

Hawaii courts interpret insurance policies under ordinary contract principles and read the policy as a whole. Clear terms are enforced according to their plain, ordinary and accepted meaning.

Ambiguity is construed for the insured

Because insurance policies are contracts of adhesion, Hawaii courts construe genuine ambiguity in favor of the insured and against the insurer, while declining to manufacture ambiguity from mere disagreement over meaning.

Reasonable expectations matter

Dairy Road Partners v. Island Insurance Co. and later Hawaii Supreme Court decisions instruct courts to read insurance policies in light of the objectively reasonable expectations of a lay policyholder.

Statutory motor-vehicle requirements can override inconsistent policy language

HRS chapter 431:10C supplies mandatory liability, PIP, UM/UIM and related motor-vehicle insurance rules. Policy exclusions and conditions must therefore be checked against the governing statute and current Hawaii appellate law.
