Borrowed and non-owned vehicles create overlapping coverage questions

Analyze the owner’s liability policy, the driver’s own automobile policy, permissive-use language, non-owned auto provisions, and any employer or commercial coverage. Insured status and priority can differ by coverage part.

Rental-company liability is separate from renter liability

The federal Graves Amendment, 49 U.S.C. § 30106, generally bars vicarious liability against a rental owner based solely on vehicle ownership, while preserving claims based on the rental company’s own negligence or criminal wrongdoing. Idaho insurance obligations and the renter’s liability remain separate issues.
