Scope of employment controls employer tort liability

Idaho respondeat-superior law generally makes an employer liable for employee torts committed within the scope of employment. Idaho appellate decisions distinguish that tort analysis from broader workers’ compensation concepts and do not automatically import workers’ compensation “coming and going” exceptions into third-party respondeat-superior cases.

Business use can activate additional coverage layers

  • Employee personal auto insurance.
  • Employer commercial-auto coverage.
  • Hired and non-owned auto coverage.
  • Fleet or self-insurance arrangements.
  • Umbrella and excess insurance.
