Settlement control creates duties to protect the insured from excess exposure

When liability and damages threaten to exceed policy limits, the insurer’s settlement handling implicates the insured’s personal exposure. The relevant duty is owed to the insured whose financial interests the carrier controls through defense and settlement decisions.

Axsom recognizes liability for bad-faith failure to settle

Allstate v. Axsom recognizes that an insurer that fails in good faith to settle can be liable for the amount of an excess judgment and, on the required proof, punitive damages. The doctrine is distinct from a third-party claimant’s direct rights.

Preserve the exact settlement opportunity

Keep the full demand, proposed release, delivery proof, deadline, liability/damages materials, competing claims and all carrier/insured communications. A ‘policy-limits demand’ label is not a substitute for analyzing whether the opportunity was reasonable and would protect the insured.

Connect the handling to actual excess loss

Document the eventual judgment or settlement, carrier payment and amount the insured personally paid or became obligated to pay. A bad outcome alone does not prove bad faith; show how the settlement handling caused the excess loss.
