Indiana Work, Employer & Commercial Vehicle Coverage

Identify the employer, trip purpose and vehicle relationship
Identify the employer, job duties, trip purpose, dispatch/customer instructions, vehicle owner/lessee and reimbursement or route records. Employee status or use of a company vehicle is evidence to investigate, not automatic proof of scope.
Indiana scope of employment is a business-purpose and deviation inquiry
Cox explains that conduct may be within scope when incidental to authorized conduct or appreciably furthering the employer’s business. Scope is often a fact question where reasonable inferences differ, especially with mixed personal/business travel.
Direct employer negligence can overlap but should not be duplicated mechanically
Sedam holds that when an employer admits respondeat-superior responsibility under the circumstances addressed, redundant negligent-hiring/retention theories can be precluded. Do not overgeneralize that rule to every direct-employer claim; identify the specific theory and whether it adds a distinct legal issue.
Commercial insurance remains a separate coverage question
Separately identify commercial auto, hired/non-owned auto, umbrella/excess and the driver’s personal policy. Employer liability and insurance coverage overlap but require independent policy analysis.
