Tender the lawsuit promptly and preserve the pleadings

Provide the petition, summons and amended pleadings to every potentially applicable liability carrier through the required notice channel and keep proof of delivery. Calendar court deadlines independently.

The duty to defend is broader than ultimate indemnity

McAndrews states that the defense obligation arises when there is potential or possible liability to pay under the policy. The insured can be entitled to a defense even though the insurer ultimately owes no indemnity.

Iowa may look beyond the four corners when needed

The duty analysis usually begins with the petition but can include other admissible and relevant facts where notice pleading or disputed coverage facts make the complaint insufficient to decide potential coverage.

Keep defense, indemnity and settlement exposure separate

A carrier can defend while reserving coverage issues. Track the defense position, reserved exclusions, indemnity analysis and settlement handling independently so one is not mistaken for an admission or waiver of another.

Closing guidance

Tender promptly, compare the claims and relevant facts with the complete policy, and treat defense and indemnity as related but separate obligations.
