Identify the insurance the agent actually undertook to obtain

Langwith confirms that an Iowa insurance agent must use reasonable care, skill and diligence in procuring the insurance requested by the client. Preserve the application, quotes, binder, declarations, endorsements and communications showing the requested coverage, limit, vehicle and insured.

A broader advisory duty depends on the relationship and undertaking

Iowa does not make every insurance agent a general risk manager. Langwith rejected an artificially narrow test, but the client still must show facts supporting a broader undertaking or advisory relationship. General hindsight that more insurance would have been useful is not enough.

Compare the procurement record with the policy actually issued

Determine whether the missing protection reflects an agent error, a valid written rejection, or an insurer interpretation dispute. For UM/UIM, compare the application and signed rejection documents with Chapter 516A. Keep procurement and policy-interpretation theories analytically separate.

Causation requires showing what the missing coverage would have paid

Establish whether the requested insurance was available, whether the applicant qualified, what limit/premium would have applied and whether the coverage would have responded to the crash. Damages are tied to the uninsured loss caused by the procurement failure.

Closing guidance

An Iowa procurement claim should identify the requested protection, the agent's undertaking, the policy delivered and the loss the missing insurance would have covered.
