Kansas Settlement, Release & Claim Closure

Read the release by the parties and claims it actually names
Kansas comparative-fault law no longer treats release of one potential tortfeasor as automatically releasing all others. Luther creates a rebuttable presumption that a person or entity not specifically named or identified in the release was not intended to be released. Still, the actual wording and negotiated intent matter.
A partial settlement does not automatically erase claims against other comparatively liable parties
Luther holds that release of a party who may bear some percentage of fault does not affect the plaintiff’s right to recover against other parties whose fault contributed to the injury. Model the remaining comparative-fault case rather than assuming the settlement amount or release extinguishes other claims.
Follow the 60-day UIM substitution procedure before releasing an underinsured tortfeasor
K.S.A. 40-284(f) requires certified notice of a tentative liability-limits settlement to the UIM carrier with specified materials. The carrier has 60 days to substitute payment if it wishes to preserve statutory subrogation. Complete that process before executing the tortfeasor release.
Resolve PIP reimbursement and perfected hospital liens before distribution
A tort settlement can be subject to the PIP lien under §40-3113a and hospital liens under §§65-406–408. Confirm signing authority in wrongful-death/survival matters and maintain a closing ledger showing every payment, lien resolution and claim intentionally left open.
