Build the coverage map from the people, vehicles and trip purpose

Identify every driver, registered owner, passenger, household member, employer/business connection, rental/platform relationship and umbrella/excess lead. Record insurer, underwriting company, policy number, named insured, vehicle and accident-date effective period. An insurance card is one policy lead, not a complete coverage investigation.

Request the full accident-date contract and UM selection history

For each lead, obtain declarations, policy forms, all endorsements, effective dates and written coverage positions. For UM/UIM, request the prescribed rejection/lower-limit/economic-only form and relevant policy history because a valid initial form can continue through qualifying renewals, reinstatements, substitutes or amendments. Do not substitute a later policy or generic form for the accident-date contract. Personal and commercial UM elections follow different statutory rules. Obtain the actual form rather than assuming a generic rejection proves the coverage available.

The current direct-action statute has listed exceptions; filing dates matter

Current R.S. 22:1269(B)(1) generally permits direct action against a liability insurer only when a listed exception applies. Coverage investigation should not assume that the insurer can be named as a defendant at filing. Preserve the insured and insurer identities, service history, bankruptcy or insolvency facts, coverage positions and reservation-of-rights correspondence. Act 275 took effect August 1, 2024. Before applying the amended restrictions to an older accident or an already-filed case, review the filing and insurer-joinder dates and the applicable judicial decisions; this guide does not decide those transitional issues.

Litigation provides formal discovery of qualifying insurance agreements

Louisiana Code of Civil Procedure art. 1423 expressly allows discovery of the existence and contents of insurance agreements that may satisfy, indemnify or reimburse a judgment. Use that procedure to test voluntary information and identify liability/excess agreements once suit is pending. Production identifies possible coverage but does not establish that the policy actually covers the accident. This discovery provision does not itself create an automatic pre-suit production deadline.

Closing guidance

Find Louisiana coverage by tracing every person, vehicle and business relationship, obtaining the actual contracts, and using art. 1423 discovery when litigation begins. Do not assume direct-action joinder or a policy-limit statement answers the coverage question.
