The $500,000 statutory cap applies to the specified personal-injury or wrongful-death damages, but the statute excludes property damage, medical care and related benefits, and specified earnings/support categories from that cap. Do not report the cap as a universal all-in $500,000 maximum without separating the excluded damage categories and checking the defendant/entity.

State and state-agency lawsuits have special forum and service requirements

R.S. 13:5106 requires covered governmental suits to proceed in Louisiana state court. For the State or a state agency, R.S. 13:5107 requires the appropriate citation/service and request for service on the Attorney General within ninety days of filing, together with service on the proper department, board, commission, agency head or other person as the statute requires. Public-entity insurance and indemnity should be investigated separately from the statutory cap

Identify the agency/parish/municipality, employee scope, self-insurance, commercial policy or risk program and any specialized immunity/statute. The constitutional waiver and §13:5106 cap do not mean every public entity is liable on the merits or that every category of damages is capped identically.
