Massachusetts Auto Insurance & Crash Law
VictimsGuide’s Massachusetts library organizes the rules that matter after a serious motor-vehicle crash: compulsory auto insurance, personal-injury protection, the tort threshold, uninsured and underinsured motorist coverage, claims handling, employer and commercial coverage, government claims, comparative negligence, damages, settlement, liens, subrogation and controlling case authority.
Massachusetts rules to identify early
- Minimum liability: for policies issued or renewed on or after July 1, 2025, compulsory bodily-injury limits are 25/50 and compulsory property-damage coverage is $30,000.
- PIP: Massachusetts provides up to $8,000 per person in no-fault PIP benefits, subject to health-insurance coordination and other statutory rules.
- Tort threshold: recovery for pain and suffering generally requires more than $2,000 in reasonable and necessary medical expenses or satisfaction of a statutory injury exception.
- UM/UIM: compulsory uninsured-motorist coverage is 25/50; underinsured-motorist coverage is optional and must be evaluated separately.
- Comparative negligence: Massachusetts follows modified comparative negligence and bars recovery only when claimant negligence is greater than the combined negligence of defendants.
Preserve the policy, PIP records, UM/UIM endorsements, crash report, photographs, video and electronic evidence, and investigate employer, commercial, umbrella and excess coverage before signing a release.
