Required Coverage

Start with 25/50/25 liability, then identify the UM election

Miss. Code § 63-15-43 sets the minimum motor-vehicle liability limits at $25,000 for bodily injury or death to one person, $50,000 for two or more persons in one accident, and $25,000 for property damage.

Minimum limits do not establish the actual policy

The declarations page may show higher liability limits, umbrella coverage, commercial coverage, or other layers. Serious-loss investigation should obtain the complete policy and declarations rather than relying on the statutory floor.

UM coverage is separate and generally mandatory unless rejected

Miss. Code § 83-11-101 requires bodily-injury UM coverage at least equal to the statutory minimum unless an insured named in the policy rejects the coverage in writing. Higher UM limits may be purchased up to the policy’s liability limits, subject to the statute. A valid rejection and approved disclosure/selection process matter when an insurer contends UM does not apply.

Coverage checklist

  • Liability declarations and complete policy.
  • UM limits and written rejection/selection form.
  • All covered vehicles and named insureds.
  • Umbrella, excess, employer, commercial, rental, P2P, and TNC coverage.
  • Any qualifying four-or-more-vehicle nonstacking UM election.
Bottom line. Mississippi’s minimum liability structure is 25/50/25, but actual recovery depends on the issued policy, the UM election, and every additional insurance layer that may apply.

Official sources for the coverage file

The Mississippi Insurance Department’s auto-insurance page reports liability minimums of $25,000 per person, $50,000 per accident for bodily injury, and $25,000 for property damage. Use the declarations and complete policy to identify the limits actually purchased.

The Department’s Bulletin 2014-4 and attached model UM selection/rejection form explain the information and signed-form process adopted in 2014. Obtain the form used for the particular policy, including the bodily-injury and property-damage choices, rather than relying on a general statement that UM was rejected.

Official agency sources checked October 15, 2026. The bulletin is a dated agency source; current statutory text, later changes and the validity of a particular election require separate verification.
