Mississippi Auto Insurance & Crash Law
VictimsGuide’s Mississippi library organizes the rules that matter after a serious motor-vehicle crash: required liability insurance, uninsured and underinsured motorist coverage, stacking, policy interpretation, coverage disclosure, claims handling, employer and commercial coverage, government claims, comparative negligence, damages, medical liens, settlement and controlling case authority.
Mississippi rules to identify early
- Minimum liability: Mississippi requires at least $25,000 per person, $50,000 per accident for bodily injury, and $25,000 for property damage.
- UM/UIM: uninsured-motorist coverage and any written rejection should be examined with the declarations, endorsements and household policies.
- Comparative negligence: Mississippi follows pure comparative negligence, so fault allocation can reduce damages without necessarily eliminating recovery.
- Government vehicles: claims involving public entities require separate Mississippi Tort Claims Act analysis, including notice, immunity and damages limitations.
Start with the policy and the evidence
Do not assume the visible driver’s personal policy is the only coverage. Preserve the declarations and endorsements, crash report, photographs and electronic evidence, then investigate household, employer, commercial, umbrella, excess and other potentially applicable policies before signing a release.
