STATE LAW – MISSISSIPPI LIBRARY – GUIDE 04
Who Is an Insured Under Mississippi Auto Insurance?
Mississippi insured status depends on the particular coverage. Liability insured status, UM insured status, vehicle occupancy, household relationships, and policy definitions must be analyzed separately.

Insured Status
There is no single definition of insured for every automobile claim
A person may be protected by one coverage and not another. Start with the statutory coverage at issue, then read the policy definition of insured and the relevant vehicle or household terms.
UM insured status comes before stacking
Mississippi traditionally permits stacking of applicable UM coverage, but Glennon v. State Farm makes an important point: a claimant cannot stack coverage on vehicles for which the claimant is not an insured. Before adding limits, determine insured status under each policy and vehicle.
Policy language matters
Lewis v. Allstate and Universal Underwriters v. Buddy Jones Ford apply Mississippi insurance-contract principles: clear language receives its plain meaning, while genuine ambiguity is construed against the insurer. Quote the exact definition, exclusion, or condition rather than relying on labels.
Facts to document

- Vehicle ownership, title, and permission.
- Occupancy and vehicle use at the time of loss.
