NEW MEXICO GUIDE 17
New Mexico Comparative Negligence & Crash Liability
New Mexico follows pure comparative negligence. A claimant’s damages are reduced in proportion to the claimant’s share of fault, but partial fault does not by itself bar recovery.
- Identify every potentially responsible driver, owner, employer, public entity and other actor.
- Preserve physical, electronic and witness evidence relevant to fault allocation.
- Separate factual causation from legal allocation of fault.
- Apply current New Mexico comparative-fault statutes and controlling appellate authority.
