STATE LAW – NEW MEXICO LIBRARY – GUIDE 07
New Mexico Insurance Policy Interpretation, Exclusions & Coverage Disputes
Coverage disputes require reading the policy as a whole and applying New Mexico statutes and controlling case law to insuring agreements, definitions, exclusions, conditions and endorsements.

- Identify the coverage grant and insured status.
- Read definitions with the operative coverage.
- Review exclusions, exceptions, conditions and endorsements.
- Check whether mandatory New Mexico law affects policy language.
New Mexico reads insurance policies as a whole
New Mexico courts interpret insurance policies under ordinary contract principles while recognizing the strong public policies embedded in the Insurance Code and Mandatory Financial Responsibility Act. Clear terms are generally enforced according to their plain meaning.
Ambiguity and reasonable expectations remain important
Genuine ambiguity is construed against the insurer, and New Mexico appellate decisions also protect objectively reasonable expectations where policy wording, disclosures, or statutory requirements create uncertainty about the coverage purchased.
UM/UIM offers, rejection forms, stacking waivers, declarations, and endorsements should therefore be read together rather than in isolation.
