Tender the claim and every lawsuit promptly

Send the insurer the demand, complaint, summons and amendments, identify the policy and request a written defense decision. Preserve proof of delivery and all deadlines for responding in court. In Atmed, the Court noted a substantial delay between the civil suit and notice to the insurer. Its administrative-charge ruling did not decide every question about the later suit. Do not assume that notice of an earlier demand automatically supplies notice of a later proceeding or revised allegations.

Compare pleaded facts with the coverage and exclusions

Rhode Island applies the pleadings test. As Atmed explains, allegations bringing an injury within, or potentially within, policy coverage trigger the insurer’s duty to defend regardless of the insured’s ultimate liability. Read the allegations with the actual coverage terms and exclusions. The question is not simply whether the claimant is likely to win, and a negligence or intentional-tort label alone does not substitute for examining the facts alleged.

Potential coverage still requires an exclusion analysis

Atmed applied the discrimination exclusion to the allegations before the Human Rights Commission and found no duty to defend that charge. The Court expressly declined to decide whether the charge qualified as a covered suit because the exclusion resolved the issue. That commercial general-liability decision explains the interpretive method; it does not impose its discrimination wording on auto policies. Obtain the actual auto endorsement and test every relevant exclusion and exception against the pleaded facts.

Treat a reservation of rights as an issue to examine

A reservation letter may accompany an insurer’s agreement to defend while preserving a dispute about coverage. Ask which allegations and provisions are reserved, who will defend, how defense costs will be handled and whether any conflict needs legal review. Atmed describes Travelers agreeing to participate in the later civil defense under a reservation, even though it disputed earlier costs. A reservation is not itself a final adjudication of coverage, and the letter alone does not decide every counsel or reimbursement question.

Identify the primary and excess defense obligations

Collect all potentially applicable policies and compare their coverage grants, endorsements and other-insurance provisions. In Empire, a leased-auto additional-insured endorsement and the policy as a whole established Citizens as primary and Empire as excess; Citizens owed the defense costs Empire had incurred on its behalf. The Court did not apportion those costs merely because two policies existed. Whether another case requires sharing, exhaustion or excess participation depends on the actual policies and applicable law.

Preserve defense costs and keep indemnity separate

Keep defense invoices, counsel correspondence, tenders, reservations, denials and settlement communications. A defense inquiry based on potential coverage does not establish the amount the insurer must ultimately pay toward a judgment or settlement. If a defense is denied or disputed, protect the underlying response deadline and obtain prompt advice about the coverage dispute and defense arrangements. Atmed also shows why alleged claims-handling misconduct needs its own careful analysis rather than being assumed from the outcome of one defense issue.
