Tennessee Government Vehicle Crashes, GTLA & State Claims Commission

Tennessee governmental vehicle claims depend on which public entity owns or operates the vehicle. The Governmental Tort Liability Act removes local-government immunity for injuries resulting from negligent operation of a motor vehicle by an employee acting within the scope of employment, subject to statutory exceptions and limits. Claims against the State follow the Tennessee Claims Commission framework.

Local-government vehicle claims use the GTLA

Section 29-20-202 removes local-government immunity for injury arising from negligent operation of a motor vehicle by an employee acting within scope, subject to statutory exceptions and defenses.

Current GTLA limits remain 300/700/100

For actions arising on or after July 1, 2007, §29-20-403 generally limits local-government exposure to $300,000 per person, $700,000 per occurrence for bodily injury or death, and $100,000 property damage. A 2025 proposal to increase these limits did not become law.

State employee vehicle claims use the Claims Commission

Claims against the State of Tennessee follow §9-8-307 and the Claims Commission rather than the GTLA. The statute includes negligent operation or maintenance of motor vehicles by state employees and sets a different damages framework.

Government claims have specialized procedure

Identify the governmental entity at the outset and calendar its special forum, notice and filing requirements. Do not assume the ordinary private-defendant limitation period or procedure controls a government-vehicle claim.
