Finding Applicable Insurance Coverage After a Texas Crash

Build a coverage inventory around the people, vehicles and trip. One insurance card rarely answers every coverage question.

Start with the crash facts

Identify every driver, registered owner, lessee, passenger and business connected with the trip. Record who gave permission to use each vehicle and whether the driver was working, making deliveries, using a rideshare app, driving a repair-shop loaner or using a rental. These facts can change which policy must be examined.

Separate potential liability coverage for responsible people from benefits available to the injured person. The first list may include owner, driver, employer, commercial, umbrella and excess policies. The second may include household UM/UIM, PIP, medical-payments and collision coverage. Presence on the list means investigate, not that coverage has been established.

Request the complete policy for the loss date

Ask for declarations, the policy form, all endorsements, coverage limits, effective dates, named-insured information and any written UM/UIM or PIP rejection. Request earlier policies when a carrier relies on a prior rejection or renewal provision. Save the response and any explanation of why a document was withheld.

Transportation Code § 601.053 concerns evidence of financial responsibility. It should not be described as a universal pre-suit right to every insurance contract or a deadline for full policy-limit disclosure. Texas litigation discovery rules provide a separate route when a suit is pending.

Use the appropriate discovery route

Texas Rule of Civil Procedure 192.3(f) permits discovery of specified insurance agreements that may satisfy a judgment or reimburse payments. Rule 194.2(b)(7) includes such agreements in initial disclosures in cases governed by that rule. Applicability, exemptions, deadlines and the case’s discovery plan still matter.

Request relevant umbrella, excess and business policies expressly. For a nonparty holder, counsel should select the proper production or subpoena procedure; a letter alone does not compel production. Discoverability does not make the agreement admissible at trial or establish that the policy covers the claim.

Resolve missing layers and conflicting answers

Create a log with one row per policy: insured, insurer, coverage, limits, priority, notice date, documents received and unresolved issue. Ask the carrier to identify the precise exclusion or condition supporting a denial. Compare its answer with the actual form rather than the insurance card.

For rideshare crashes, Chapter 1954 supplies a specific claim-investigation assistance provision addressing app log-on/off times and coverage information. Preserve that evidence promptly. Before signing a release, review whether another policy needs notice or consent and whether the proposed terms could impair an unresolved claim.
