STATE LAW – TEXAS LIBRARY – GUIDE 10
Texas Insurance Agents, Applications & Failure to Procure Coverage
A dispute about insurance procurement starts with what was requested, what was represented and what coverage could have been obtained.

Identify the promise or request
Preserve the application, quotes, binder, declarations, renewal notices and all communications with the agent or broker. Write down the coverage requested, the limits discussed, the intended drivers and vehicles, and any disclosed work, delivery or rideshare use. A general wish for full coverage is less precise than a request for a particular protection.
Compare what was requested with what was issued. A binder, quote and policy are different documents. Determine whether the dispute concerns an unsubmitted application, an omitted endorsement, incorrect information, a representation about benefits or failure to explain a rejection.
Check the coverage records first
An asserted procurement failure may disappear or change when the complete policy is obtained. Inspect all endorsements and any written UM/UIM or PIP rejection under Chapter 1952. Ask for the transmission and signature records associated with disputed forms. Do not treat a missing declarations entry as conclusive proof that no coverage exists.
If the carrier has denied the loss, request its exact contractual basis. The procurement question and the insurer’s interpretation question may require different claims and different defendants.
Misrepresentation and loss need proof
Insurance Code § 541.061 addresses specified policy misrepresentations. Chapter 541’s private-action, notice, damages and limitation provisions require separate review. The statutory text does not establish that every agent has a general duty to recommend all possible insurance or that every misunderstanding creates liability.
For a negligence or failure-to-procure theory, obtain case-specific legal research on the undertaking, duty, breach and causation. Determine whether the requested insurance was available, whether the applicant qualified, what it would have cost and whether it would actually have covered this loss. This guide does not certify an unresearched agent-duty rule.
Prepare a reviewable chronology
Create a dated sequence from the first request through issuance, renewal, accident and denial. Save the original messages and attachments rather than only recollections. Identify who made each statement and whether that person acted for an insurer, agency or another intermediary.
Collect the financial consequence of the asserted omission and distinguish it from losses excluded for independent reasons. Notify potentially responsible parties appropriately and seek timely review. Filing a TDI complaint can document a concern but does not substitute for proving a civil claim or meeting its deadline.
