Texas PIP/MedPay, Hospital & EMS Liens, Subrogation & Reimbursement
Texas auto policies must provide personal injury protection unless a named insured rejects PIP in writing. PIP pays covered medical and funeral expenses and specified lost-income and substitute-services benefits without regard to fault; the statutory minimum offering is $2,500 per person. MedPay is a separate contractual coverage.
- Obtain the declarations page and any written PIP rejection before assuming PIP is unavailable.
- Track medical expenses, lost income, substitute services and all PIP/MedPay payments or denials.
- Review hospital and emergency-medical-services liens, health-plan reimbursement and statutory lien perfection before settlement.
- Coordinate PIP/MedPay, UM/UIM and liability recovery without duplicating the same loss.
