Utah Comparative Fault & Crash Liability
Utah uses a modified comparative-fault system. A claimant may recover only from a defendant or group of defendants whose combined fault exceeds the claimant’s fault, with damages reduced according to the claimant’s allocated share.
- Identify every potentially responsible driver, owner, employer, public entity and other actor.
- Preserve physical, electronic and witness evidence relevant to fault allocation.
- Separate PIP benefit entitlement from tort-fault allocation.
- Apply current Utah Code § 78B-5-818 and controlling appellate authority.
