Utah Coverage Disclosure & Insurer Duties
Coverage investigation should identify every known policy, limit, insured relationship and unresolved coverage issue that may affect recovery after a Utah crash.

- Request declarations and complete applicable policy forms.
- Ask about umbrella, excess, employer, commercial and additional-insured coverage.
- Preserve written representations concerning limits and coverage positions.
- Compare insurer disclosures with facts developed through investigation.
Utah regulates unfair claim-settlement practices
Utah Code § 31A-26-303 prohibits specified unfair claim-settlement practices, including misrepresenting material coverage facts, unreasonable delay in claim communications, inadequate investigation standards, unexplained denials or compromise offers, and failure to attempt prompt, fair, and equitable settlement when liability is reasonably clear.
The statute is regulatory, not a standalone private cause of action
Section 31A-26-303 expressly states that it does not itself create a private cause of action. Coverage-disclosure and insurer-duty issues therefore should be tied to the policy, common law, procedural rules, and any other statute that actually applies.
