Utah Insurance Policy Interpretation, Exclusions & Coverage Disputes
Coverage disputes require reading the policy as a whole and applying Utah statutes and controlling case law to insuring agreements, definitions, exclusions, conditions and endorsements.

Source check: October 22, 2026. Keep the policy period, loss date and applicable statutory version distinct.
Start with the policy and the coverage being requested
Collect the declarations, coverage forms, endorsements, applications made part of the contract, and any later change notices. Record each form number and edition date. Identify the person seeking benefits, the vehicle involved and the coverage at issue. Liability, PIP, UM and UIM questions require separate analysis.
Check provisions incorporated by reference
Utah Code 31A-21-106(1) regulates agreements and provisions incorporated into an insurance policy. Its rule addresses provisions fully set out in the policy or an attached application or document, and also permits incorporation where the policy, application or agreement accurately reflects the incorporated terms. Do not assume that a missing attachment alone resolves the coverage question.
The section also contains exceptions, including specified filed rate materials, certain arrangements authorized by the commissioner, and incorporation of laws, rules or public directives by citation. Ask the insurer to identify the incorporated material and the statutory basis it relies on.
Distinguish a change during the policy term from renewal
Under section 31A-21-106(2)–(4), a purported modification during the policy term generally cannot alter a party’s obligations unless it is written and agreed to by the party adversely affected. The statute contains exceptions, including changes mandated by law and specified group-contract and other provisions. It separately allows uniform premium increases for comparable persons at renewal.
Preserve the original policy, the proposed change, the delivery date and any record of agreement. Determine whether the issue concerns a midterm modification, a renewal or a change required by law before applying the rule.
Compare liability wording with the motor-vehicle statute
Utah Code 31A-22-303(1) sets requirements for motor-vehicle liability coverage, including the policy information and insured-person provisions described there. Its owner-policy and resident-relative provisions must be read with the section’s qualifications and its express reference to section 31A-22-302.5. Section 303 also addresses permitted limitations and excluded liabilities; its requirements should not be treated as a universal rule for every kind of auto coverage.
Subsection (5) addresses an insurer’s good-faith duty to defend an insured against a claim or suit seeking damages payable under the liability policy. Keep a request for a defense distinct from a request for payment of first-party benefits.
Request a written explanation tied to the policy version
Ask the insurer to identify the coverage grant, definition, exclusion, endorsement and statutory provision supporting its position. Compare that explanation with the complete contract and keep a chronology of notices and responses. Track deadlines independently of the coverage discussion.
Research scope: The publisher’s current versions checked here are effective May 9, 2017 for section 106 and May 3, 2023 for section 303. Earlier losses, other coverages and appellate interpretation require additional review. A recent check date does not mean that either section was amended in 2026.
