Utah Stacking & Multiple Insurance Policies

Stacking analysis asks whether more than one independently applicable coverage may respond to the same loss. The answer depends on insured status, policy wording, statutory restrictions and current Utah law.

  • Identify every potentially applicable policy and limit.
  • Determine whether each policy independently covers the claimant and occurrence.
  • Review anti-stacking, other-insurance and anti-duplication provisions.
  • Apply current Utah UM/UIM statutes and appellate authority.

Utah limits interpolicy stacking

Utah Code §§ 31A-22-305 and 31A-22-305.3 prohibit interpolicy stacking of UM and UIM except to the extent expressly allowed by statute.

Occupied-vehicle coverage is generally primary

Coverage on the occupied vehicle is generally primary, with qualifying elected household coverage secondary. The UM and UIM statutes permit additional recovery in specified pedestrian and non-owned-vehicle circumstances; the claimant must satisfy the relevant insured-status and vehicle-use requirements. The primary and secondary coverages may not be set off against each other, and recovery under available policies cannot exceed full damages.

A separate-household exception may protect a dependent minor

Utah Code 31A-22-305(8)(c) and 31A-22-305.3(4)(b)(iii) allow a qualifying dependent minor whose parents live in separate households to recover from up to two additional policies, one from each parent’s household. The minor must be injured while occupying or using a vehicle that is not owned, leased or furnished to the minor, the minor’s resident parent or resident sibling. Each parent’s policy bears the proportion of damages specified by the statute.
