STATE LAW – WASHINGTON LIBRARY – GUIDE 03
Finding Every Insurance Policy After a Washington Crash
The insurance card identifies a policy. It does not identify every source of coverage. A complete Washington crash investigation should trace the driver, vehicle owner, household, employment, business use, rental or rideshare status, umbrella coverage, UIM, PIP and any other insurance capable of responding to the loss.

Build a coverage map from the crash facts
Identify the driver, vehicle owner, employer, household, trip purpose and any rental, delivery or rideshare activity. Request the accident-date declarations, complete policy form and endorsements for each potential owner, driver, household, business, umbrella or excess policy. Keep liability insurance separate from UIM, PIP and other first-party benefits. An insurance card is a lead to a contract; it does not establish all available coverage.
Use Washington’s litigation discovery rule
CR 26(b)(2) allows a party to obtain discovery and production of qualifying insurance agreements and documents affecting coverage, including denials, coverage extensions and reservations of rights sent to the covered person or representative. The rule distinguishes discoverability from admissibility at trial and does not treat the insurance application as part of the agreement for this purpose.
This is a litigation discovery rule, not a general pre-suit deadline for every insurer to disclose a policy. Apply court orders, privilege protections and the other discovery rules. Request the actual loss-date documents and identify missing layers in a written coverage log.
Resolve missing records before evaluating a release
Record the underwriting company, policy number, insureds, covered vehicles, limits, notice dates and each unresolved coverage position. Review settlement conditions, possible first-party claims and reimbursement demands before accepting a release. A coverage investigation does not extend a filing deadline.
