Who Is an Insured Under Wisconsin Auto Insurance?

Insured status is coverage-specific
Obtain the accident-date declarations, policy form and endorsements, then identify the named insured, household relationships, vehicle, permission and purpose of use. Liability, UM, UIM and MedPay definitions require separate analysis.
Wisconsin’s owner-policy framework
For an owner’s policy subject to Wis. Stat. §632.32, subsection (3), subject to subsection (5), addresses coverage for people using a described vehicle for the purposes and in the manner described in the policy, and people legally responsible for its use. Subsection (5)(a) permits specified permission-based limits. Other provisions address motor-vehicle handlers, transferred vehicles and permitted exclusions.
These provisions do not mean that every relative or occupant is automatically insured for every coverage or receives a separate limit. Apply the policy’s definitions, permitted restrictions, statutory prohibitions and controlling cases to the person and coverage at issue.
Document the disputed facts
Preserve proof of residence, permission, employment or business use, occupancy and the coverage position. Ask the insurer to identify the exact definition or exclusion it relies on. Separate a dispute about whether a person is insured from a dispute about limits, priority, exclusions or damages.
