Pre-suit requests and litigation insurance discovery are different routes

The reviewed Alabama authorities do not establish a Colorado-style universal pre-suit statute requiring every liability insurer to disclose all limits and policy documents on demand. Before suit, request the declarations, applicable policy forms and written coverage position voluntarily and keep a dated request/response log. Once litigation begins, Alabama Rule of Civil Procedure 26 provides a formal route for discovery of qualifying insurance agreements.

Rule 26 permits discovery of qualifying insurance agreements

Alabama Rule 26(b)(3) makes discoverable the existence and contents of an insurance agreement under which an insurance business may be liable to satisfy all or part of a judgment or to indemnify/reimburse payments made to satisfy it. The rule expressly provides that this discovery does not make the insurance agreement admissible at trial. Production identifies potential coverage; it does not establish that the loss is covered.

Use Rule 34 to request the policy and related documents with precision

Rule 34 supplies the document-production procedure for materials within the opposing party's possession, custody or control. Draft requests that identify the accident-date declarations, full liability policy, endorsements, umbrella/excess agreements and other insurance agreements falling within Rule 26. Separate those materials from broader claim-file discovery, privilege/work-product issues and documents held by nonparties that may require a different procedure.

Maintain a page-by-page coverage-disclosure log

Record each request, delivery date, recipient, response, documents received and unresolved gap. If the carrier supplies only a declarations page or limit, identify the missing policy form or endorsement supporting any exclusion/priority position. When litigation begins, compare voluntary information with formal Rule 26/34 production rather than assuming the pre-suit exchange was complete.

Closing guidance

Build the insurance record voluntarily before suit when possible, then use Rules 26 and 34 to formalize insurance-agreement discovery in litigation. Disclosure identifies potential policies; coverage still requires contract and fact analysis.
