Alabama Insurance Policy Interpretation, Exclusions & Coverage Disputes

Begin with the complete policy actually issued for the loss date

Collect the declarations, insuring agreements, definitions, exclusions, conditions and every endorsement effective on the accident date. Alabama generally enforces unambiguous insurance language according to its terms. A later sample policy or an adjuster's summary does not replace the contract issued to the insured. Ask the carrier to identify the exact provision and form version supporting its position.

Ambiguity is a legal question and cannot be manufactured by strained reasoning

Herrera states that policy ambiguity is determined as a matter of law. A genuine ambiguity is construed against the insurer, but courts will not create one through strained or twisted reasoning. The mere absence of a definition does not automatically make a term ambiguous; ordinary meaning can control. State the competing reasonable readings and the exact wording creating uncertainty.

Mandatory automobile statutes can control contract terms

Coverage such as Alabama UM/UIM must be read together with § 32-7-23. A policy cannot use an exclusion or limitation to defeat protection the statute requires, while the statute also does not create benefits beyond its scope. Identify whether the disputed policy provision is required, permitted or inconsistent with Alabama law before treating the printed language as conclusive.

Respond to a denial with a clause-and-fact record

Request the insurer's written explanation identifying the grant of coverage, definition, exclusion or condition and the facts relied upon. Gather evidence directed to the disputed fact—residence, permission, vehicle use, rejection/election, notice or another condition. Keep legal interpretation and factual proof separate. A disciplined file makes it possible to evaluate both contract entitlement and any later claims-handling issue without conflating them.

Closing guidance

Read the complete accident-date policy first, then apply Alabama's plain-language/ambiguity rules and mandatory automobile statutes. Do not let a carrier summary substitute for the contract or current law.
