STATE LAW – NORTH DAKOTA LIBRARY – GUIDE 08
North Dakota Coverage Disclosure & Insurer Duties
Coverage investigation should identify every known policy, limit, insured relationship and unresolved coverage issue that may affect recovery after a North Dakota crash.

Current-law review: September 25, 2026.
- Request declarations and complete applicable policy forms.
- Ask about umbrella, excess, employer, commercial and additional-insured coverage.
- Preserve written representations concerning limits and coverage positions.
- Compare insurer disclosures with the facts developed through investigation.
North Dakota regulates unfair claim-settlement practices
North Dakota Century Code chapter 26.1-04 prohibits unfair or deceptive insurance practices, including unfair claim-settlement conduct when performed as a general business practice.
Coverage disclosure should follow the actual legal basis
Request declarations, endorsements, umbrella or excess coverage, employer/commercial policies, and other potentially applicable insurance. Do not assume a universal pre-suit policy-limits disclosure rule beyond the statute, policy, or procedural rule that actually applies.
