STATE LAW – NORTH DAKOTA LIBRARY – GUIDE 07

North Dakota Insurance Policy Interpretation, Exclusions & Coverage Disputes

Coverage disputes require reading the policy as a whole and applying North Dakota statutes and controlling case law to insuring agreements, definitions, exclusions, conditions and endorsements.

Current-law review: September 25, 2026.

  • Identify the coverage grant and insured status.
  • Read definitions with the operative coverage.
  • Review exclusions, exceptions, conditions and endorsements.
  • Check whether mandatory North Dakota law affects policy language.

North Dakota reads the policy together with mandatory statutes

Clear insurance-policy terms are generally enforced according to their ordinary meaning, but mandatory North Dakota automobile-insurance statutes form part of the coverage analysis and can control inconsistent policy restrictions.

Ambiguity is evaluated from the policy as a whole

Coverage, exclusion, priority, offset, and no-fault provisions should be read in context with the declarations and endorsements. UM/UIM and no-fault clauses should also be checked against chapters 26.1-40 and 26.1-41 before relying on policy wording alone.
