Borrowed and rental vehicles can create overlapping coverage

Analyze the vehicle owner’s policy, the driver’s own policy, permissive-use and non-owned-auto provisions, and any employer or commercial coverage. Liability insured status does not automatically answer PIP, UM/UIM, collision, or other first-party coverage questions.

Rental-owner liability is limited by federal law

The federal Graves Amendment generally bars vicarious liability against a rental owner based solely on ownership, while preserving claims based on the rental company’s own negligence or criminal wrongdoing.
