Oregon’s duty to defend turns on potential coverage

Oregon’s duty-to-defend cases require comparison of the complaint’s allegations with the insurance policy. If the allegations, reasonably interpreted, could impose covered liability, the insurer generally must defend.

The defense duty is broader than indemnity

The duty to defend can arise even though indemnity is uncertain or ultimately unavailable. Coverage defenses can be preserved through a reservation of rights while the defense proceeds.
