Delaware rules to identify early

  • Liability: Delaware requires minimum motor-vehicle liability coverage under its financial-responsibility statutes.
  • PIP: Delaware is a no-fault state for specified first-party medical and wage-loss benefits, making the PIP claim a separate track from the bodily-injury liability claim.
  • UM/UIM: uninsured and underinsured motorist coverage is governed by 18 Del. C. § 3902, including statutory offer and election requirements.
  • Comparative negligence: Delaware follows modified comparative negligence; recovery is barred only when the claimant’s negligence is greater than the defendant’s.
