Death & Survival

Section 11-7-13 creates one wrongful-death action with defined beneficiaries

Miss. Code § 11-7-13 provides a wrongful-death cause of action when death is caused by actionable wrongful conduct and identifies the persons and representative routes authorized to bring it.

The statutory classes are exclusive

The statute identifies the surviving spouse, children/descendants, parents, siblings, and representative routes and states that the list of persons entitled to bring the action is exclusive. Heirship can become a litigation issue, and the statute permits a defendant to request an heir determination within the specified period after answering.

Component claims can carry different timing rules

Mississippi decisions including Caves and related authorities caution against treating wrongful death as having one universal limitations period detached from the underlying claim. Section 15-1-49’s general three-year period does not displace shorter specialized periods such as the MTCA.

Current 2026 cases matter

Rig Masters v. Colenberg (2026) is a current fatal-crash/employer authority. Smith v. Mississippi Farm Bureau (2026) addresses timeliness of intervention in a wrongful-death/UM-UIM action after years of litigation and settlement; it is a procedural warning, not a redefinition of wrongful-death beneficiary damages.

Settlement coordination

Before distributing proceeds, identify authorized beneficiaries, estate/survival components, liens, UM/UIM rights, workers’ compensation, Medicare/Medicaid, and any court or probate procedure that applies.

Bottom line. Mississippi wrongful death is a single statutory action with exclusive beneficiary classes, but underlying claim type, timing, coverage, and settlement procedure still require separate analysis.
